Terms and Conditions

1. Services & Scope

SoulFreedom by Martina Sidler offers individual coaching and group events offline and online in Switzerland and abroad. The following General Terms and Conditions (GTC) apply to all treatments and events offered by SoulFreedom by Martina Sidler (provider) in Switzerland and abroad. By booking an offer or an individual session, the GTC are expressly accepted and become valid. Changes and side agreements are only effective if they are agreed in writing by both parties. Should any provision be or become invalid or should the GTC contain a loophole, the legal validity of the remaining provisions shall remain unaffected. The invalid provision shall then be replaced by a provision that comes as close as possible to the meaning of the invalid provision.

2. Registration & payment terms

Registration must be made in writing using the contact form on the website or by email and will be confirmed. By registering, the participant accepts the terms and conditions; registration is binding and non-transferable. Registration also entails an obligation to pay the course fees. Course materials are generally included in the course price. Expenses, e.g., for additional materials or material costs, etc., may be charged.

All payments are due within 30 days of invoicing without any deductions. For individual sessions, payment can also be made on site in cash. For annual courses, payment in installments is offered at a surcharge of 2.5% per installment. The number of installments and their intervals can be requested by the participant, but the entire amount must be paid before the first day of the course.
Non-payment of course fees does not constitute cancellation. The provider reserves the right to charge a reminder fee or to exclude the person from the offer.

Failure to pay the course fees does not constitute cancellation. The provider reserves the right to charge a reminder fee or to exclude the person from the offer.

Unless otherwise stated, all prices are in Swiss francs (CHF). SoulFreedom by Martina Sidler is not subject to VAT in Switzerland, so no VAT is shown. The provider reserves the right to change prices at any time. The prices valid at the time of conclusion of the contract on the provider's website or the prices of the individual offer apply.

3. Cancellation & postponement

For treatments, clients may cancel or reschedule free of charge up to 24 hours before the start of the individual session. If cancellation occurs within 24 hours of the appointment, the full amount will be charged. Please note: weekends and public holidays do not count, so please notify us in advance.

For courses, a cancellation fee of CHF 50 will be charged as compensation for administrative costs if the participant cancels up to four weeks before the (first) day of the course. If payment has already been made, any remaining amount will be refunded to the participant. If the participant cancels later than this, 50% of the amount is due; if the participant cancels less than two weeks before the (first) day of the course or does not show up, the full amount is due, as cancellations often affect other participants because, for example, the minimum number of participants is not reached. The provider is also under obligation, e.g. when renting rooms. If the canceled participant's place can be replaced by someone from the waiting list or if the participant provides a replacement, the full course fee minus a processing fee of CHF 50 will be refunded.

The provider reserves the right to cancel individual courses, e.g. in the event of illness or insufficient registrations. If this is the case, all payments made up to that point will be refunded. The provider also reserves the right to change the course location or adjust the course times. The participant shall have no further claims, in particular claims for damages including cancellation fees for travel or hotel costs, in the event of changes to or cancellation of an event. If an offer is jeopardized or rendered impossible as a result of force majeure, the provider may cancel or prematurely terminate the activity. The price paid will be refunded minus the services already rendered. Claims for compensation are excluded.

The same deadlines and conditions apply to postponements of courses and training by the participant to a later date as to cancellations, i.e., they are subject to a fee if they are not made in good time (see above). The only exception is illness or accident on the part of the participant (see below). In the case of offers lasting several days, it is generally not possible to postpone individual days, but only the entire offer, subject to timely notification. In order to cover unforeseen events financially, I recommend taking out appropriate cancellation insurance.

SoulFreedom by Martina Sidler reserves the right to refuse admission to an event to individual participants for important reasons or to exclude them from (further) participation. There is no entitlement to a refund of participation fees or other costs. This applies, for example, if a person's behavior significantly impairs the smooth running of the event or otherwise contributes to discord within the group.

4. Illness & accident

If someone is unable to participate in the course due to illness or accident, a corresponding medical certificate must be submitted within one week of the course date. Important: According to the recommendations of the Medical Association, a medical certificate is only valid if it contains the date, stamp, and handwritten signature of the attending physician. SMS medical certificates are therefore not accepted, but a scan of an original medical certificate is. In such cases, the course day can be made up free of charge. The amount for the original offer remains payable under the agreed payment terms. Course days must be made up in a class where there is sufficient space. All other reasons for not attending the course are the financial responsibility of the participant, i.e., they do not entitle the participant to a cost approval or to attend the course on an alternative date. The same applies to cancellations in the event of illness or accident without a doctor's certificate.

5. Online services

It is the participant's responsibility to ensure that they have the necessary technical requirements to participate in the online service. As data communication via the Internet cannot be guaranteed to be error-free and/or available at all times, the provider accepts no responsibility if participation is not possible due to technical problems.

6. Disclaimer

Participants use the services offered at their own risk; any liability for material or immaterial damage is rejected. Shamanic work, courses, and training in the field of personal development are not covered by the Heilpraktiker Act (German law governing alternative practitioners) and are not a substitute for medical or therapeutic treatment. Pregnancy, serious illnesses, and the use of psychotropic drugs must be disclosed before participation. The provider makes no promise of healing and assumes no liability for the achievement of the participant's learning goals or success. If the provider employs assistants, it assumes no liability for them. No liability is accepted for accidents and illnesses that occur during a course and/or on the way to and from the course. The same applies to personal injury attributable to a contraindication to the booked offer (e.g., in the case of mental instability). The participant is responsible for theft or loss of items; the provider cannot be held liable for this. It is therefore the participant's responsibility to ensure that they have sufficient insurance cover for direct and indirect damage (illness, accident, liability).

7. Confidentiality & Data Protection

All parties and their assistants undertake to treat all information submitted, acquired, or exchanged in connection with the services as confidential. This also applies to other participants and their patients (humans and animals). This obligation shall remain in force even after the termination of the contract. In particular, the participant undertakes to use the documents provided for personal use only and not to pass them on. Commercial use of the documents is expressly prohibited. Any reproduction, disclosure to third parties, or other use is only permitted after consultation and with the prior written consent of the organizer. No photos, video, or audio recordings may be made without the express consent of the provider.

8. Applicable law & place of jurisdiction

Swiss law applies to all legal relationships. The place of jurisdiction is Affoltern am Albis in the canton of Zurich.

9. Changes

The provider reserves the right to amend the GTC in whole or in part. Any changes will be published here. For customers, the version of the GTC that is in force at the time of conclusion of the contract applies.
